Cisco’s Trademark Case Against Apple “Silly”

Yes, that’s what an Apple spokesperson said today about Cisco’s Trademark Dispute with Apple. Meanwhile, Tom Keating did some digging and uncovered that Cisco’s case against Apple may not be so strong.

What I wonder, though, is if the fact that EVERYONE and their brother was calling it the iPhone before Apple announced anything. To me, that means one of two things:

  1. It’s not possible to confuse the two products (i.e. they fail the “confusingly similar” test).
  2. Cisco did a weak job in protecting their trademark.

Now we’re in a game of legal chicken. Let’s see who blinks first.
